Frequently Asked Questions

Do I have a personal injury case?
If you were harmed because another party acted carelessly—whether in a car accident, workplace incident, slip and fall, or similar situation—you may have grounds for a personal injury claim. We encourage you to reach out to Schilter Law so we can review the details of your situation and walk you through your legal options.
No. We will provide a free case evaluation for anyone who is interested in hiring us. We’re happy to talk with anyone who feels that they may have a case at any time.
We work entirely on what is called a contingency fee. Our fees and expenses only get paid if we win your case either through settlement or verdict. If you do not win, you do not pay. It’s that simple.
The value of your case depends on various factors, including the nature of your injuries, medical expenses, lost wages, pain and suffering, and long-term impact on your life, to name a few factors. We work to maximize your recovery based on the full extent of your damages. While every case is different, feel free to contact us and ask us for our opinion about what your case could be worth.
The vast majority of personal injury cases settle outside of court. However, if the insurance company refuses to offer fair compensation, we are fully prepared to take your case to trial.
The law varies state by state, but in Texas and in many other states, you have two years from the date of the injury to file a lawsuit. It’s important to act quickly to protect your rights.
Yes. You may still be entitled to compensation under Texas’ modified comparative negligence rule. As long as you were less than 51% at fault, you can recover damages, but your compensation would be reduced by your percentage of fault. We have recovered very significant verdicts and settlements for clients who were partially at fault, so don’t let this deter you.
It’s rarely a good idea. Insurance companies often make early, low offers to resolve claims quickly. Accepting one too soon can prevent you from receiving full and fair compensation. We review settlement offers to determine whether they truly reflect the value of your case.
Each case is different. Some cases settle without a lawsuit having been filed, and there is a two-year limitation on bringing a lawsuit. So, if a case will settle without suit, it must settle within two years. If a lawsuit is filed, there is no set timeframe. But because we work on a contingency fee (you do not pay if we do not win), we want cases to be closed as quickly as our clients do.
Seek medical attention immediately, document the scene with photos, gather witness information, and avoid speaking to insurance companies without legal representation. Insurance companies often will try to record you and ask questions that are designed to protect the insurance company’s money, not assist you in getting fair value for your case. Contact us as soon as possible to protect your rights.
At Schilter Law, we are dedicated to maximizing results for our clients, exceeding expectations, and preparing every case as if it will go to trial. Our firm is known for assertive advocacy, strategic preparation, and a client-first approach at every stage of the case.
